1. Scope
These Terms and Conditions (“Terms”) apply to all purchases made through the online store operated by:

These Terms apply to all customers purchasing products through the Seller’s website.
2. Contract Formation
The presentation of products on the website does not constitute a legally binding offer but an invitation to place an order.
By clicking the “Place Order” or “Buy Now” button, the customer submits a binding offer to purchase the products in the shopping cart.
A contract is formed only when the Seller confirms the order by email or dispatches the ordered goods.
3. Prices and Shipping Costs
All prices displayed on the website are in Euros (€) and include applicable Value Added Tax (VAT) where required by law.
Shipping charges, if applicable, will be displayed during the checkout process before the order is completed.
4. Payment Terms

The notice must clearly state the customer’s decision to withdraw from the contract.
Effects of Withdrawal
Upon receipt of a valid withdrawal request, the Seller will reimburse all payments received from the customer, including standard delivery charges, within 14 days.
Refunds will be made using the same payment method used for the original transaction unless otherwise agreed.
Customers are responsible for the direct cost of returning the goods unless otherwise stated.
Exceptions
For hygiene and health protection reasons, the right of withdrawal does not apply to sealed cosmetic or skincare products once the seal has been broken after delivery.
8. Returns and Refunds
Returned products must be unused, unopened, and in their original packaging unless the return is based on a product defect or legal warranty claim.
Refunds will be processed after inspection and approval of the returned goods.
9. Warranty
Customers are entitled to statutory warranty rights under applicable German and European consumer protection laws.
10. Limitation of Liability
The Seller shall be liable without limitation for damages resulting from willful misconduct, fraud, or gross negligence.
For minor negligence, liability is limited to foreseeable damages arising from the breach of essential contractual obligations.
Nothing in these Terms excludes liability for death, personal injury, or any liability that cannot legally be excluded.

14. Dispute Resolution

Makari De Suisse Germany is not obliged and does not agree to participate in consumer dispute resolution proceedings before a consumer arbitration board.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

1. Geltungsbereich

2. Vertragsschluss
Die Präsentation der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern einen unverbindlichen Online-Katalog.
Durch Anklicken des Buttons „Jetzt kaufen“ gibt der Kunde eine verbindliche Bestellung der im Warenkorb enthaltenen Waren ab. Der Kaufvertrag kommt erst durch unsere ausdrückliche Auftragsbestätigung oder durch den Versand der Ware zustande.
3. Preise und Zahlungsbedingungen
Alle angegebenen Preise verstehen sich in Euro (€) einschließlich der gesetzlichen Mehrwertsteuer, soweit diese anfällt.
Zusätzlich anfallende Versandkosten werden dem Kunden im Bestellprozess gesondert angezeigt.

Die Lieferzeiten werden im jeweiligen Produktangebot angegeben. Sollte ein Produkt nicht verfügbar sein, wird der Kunde unverzüglich informiert.
Das Risiko des zufälligen Untergangs der Ware geht bei Verbrauchern erst mit Übergabe der Ware an den Kunden über.
5. Eigentumsvorbehalt
Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum.
6. Widerrufsrecht
Verbrauchern steht das gesetzliche Widerrufsrecht zu.
Ausschluss des Widerrufsrechts
Aus Gründen des Gesundheitsschutzes und der Hygiene besteht kein Widerrufsrecht bei versiegelten Kosmetik- und Pflegeprodukten, wenn deren Versiegelung nach der Lieferung entfernt wurde.
Im Übrigen gelten die gesetzlichen Bestimmungen zum Widerrufsrecht.
7. Gewährleistung
Es gelten die gesetzlichen Gewährleistungsrechte der Bundesrepublik Deutschland.
Bei offensichtlichen Transportschäden wird der Kunde gebeten, diese unverzüglich beim Zusteller zu reklamieren und uns zu informieren.
8. Haftung
Wir haften uneingeschränkt für Vorsatz und grobe Fahrlässigkeit sowie bei Verletzung von Leben, Körper oder Gesundheit.
Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten und beschränkt auf den vorhersehbaren, vertragstypischen Schaden.
Die Vorschriften des Produkthaftungsgesetzes bleiben unberührt.
9. Produktinformationen
Unsere Kosmetik- und Hautpflegeprodukte dienen ausschließlich der äußerlichen Anwendung.
Die Produktbeschreibungen und Anwendungshinweise sind zu beachten. Bei bekannten Allergien oder Hauterkrankungen empfehlen wir, vor der Anwendung ärztlichen Rat einzuholen.
Die dargestellten Produktbilder können geringfügig vom tatsächlichen Produkt abweichen.
10. Datenschutz
Die Verarbeitung personenbezogener Daten erfolgt gemäß unserer Datenschutzerklärung in Übereinstimmung mit der Datenschutz-Grundverordnung (DSGVO).

Für Verbraucher gilt diese Rechtswahl nur insoweit, als dadurch nicht der Schutz zwingender Bestimmungen des Rechts des Staates entzogen wird, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat.
13. Schlussbestimmungen
Sollten einzelne Bestimmungen dieser AGB ganz oder teilweise unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.
